Mounting concerns are being raised as the FBI served a search warrant at Fulton County, Georgia’s election headquarters, seeking 2020 election ballots. The action, which critics say fits into a pattern of President Donald Trump using federal agencies to pursue personal grievances related to his electoral defeat, comes more than five years after he lost the presidential race to Joe Biden.

The FBI’s move in Georgia followed Trump’s comments earlier this month at the World Economic Forum in Davos, Switzerland, where he hinted at possible charges connected to the 2020 election. This development has alarmed legal experts and voting rights advocates alike.

“The man has obsessions, as do a fair number of people, but he’s the only one who has the full power of the United States behind him,” said Rick Hasen, a UCLA law professor, expressing concern over the president’s continued focus on the 2020 election.

Georgia Senator Jon Ossoff drew parallels between the FBI search and the recent immigration operation in Minnesota that resulted in the deaths of two U.S. citizen protesters. That action targeted a governor who had opposed Trump in the 2024 election as Vice President Kamala Harris’s running mate.

“From Minnesota to Georgia, on display to the whole world, is a President spiraling out of control, wielding federal law enforcement as an unaccountable instrument of personal power and revenge,” Ossoff stated.

The timing of the search is particularly concerning to election officials nationwide who are preparing for the 2026 midterm elections. Trump faces the challenge of helping Republicans maintain control of Congress, and some fear this action in Georgia signals potential interference in future elections.

Kristin Nabers of voting rights group All Voting Is Local warned, “Georgia’s a blueprint. If they can get away with taking election materials here, what’s to stop them from taking election materials or machines from some other state after they lose?”

Georgia has been central to Trump’s election fraud claims since 2020. In January 2021, he infamously called Republican Secretary of State Brad Raffensperger asking him to “find” 11,780 votes to reverse Biden’s narrow victory. Raffensperger refused, citing multiple reviews confirming Biden’s win in the state.

These reviews were part of extensive audits and recounts in battleground states, many conducted by Republicans, that consistently affirmed Biden’s victory in Georgia, Michigan, Wisconsin, and Nevada. Trump’s legal challenges failed in dozens of courts, and his own attorney general at the time stated there was no evidence of widespread fraud.

Several Trump allies who promoted his election fraud claims have faced significant legal consequences. Former New York Mayor Rudolph Giuliani was ordered to pay $148 million to two Georgia election workers for defamation. Voting machine companies successfully sued conservative media outlets over false claims, including a $787 million settlement paid by Fox News.

A separate prosecution attempt by Fulton County District Attorney Fani Willis against Trump collapsed amid conflict-of-interest allegations, and Trump has since filed suit against her.

Since returning to office, Trump has taken several controversial actions related to the 2020 election and its aftermath. On his first day back in the White House, he pardoned or commuted sentences for approximately 1,500 people charged in connection with the January 6, 2021, Capitol attack. He signed an executive order attempting to set new rules for state election systems, though judges have repeatedly blocked it, citing constitutional limits on presidential authority over elections.

Trump has also suggested criminal charges against lawmakers who served on the House committee investigating January 6 and targeted former federal officials who publicly defended the integrity of the 2020 election.

Despite the pressing demands of the presidency, including international conflicts and domestic policy challenges, Trump continues to focus on the 2020 election. He has installed a White House plaque claiming Biden took office after “the most corrupt election ever” and regularly repeats false claims about the election being “rigged.”

David Becker, a former Justice Department voting rights attorney and executive director of the Center for Election Innovation & Research, expressed skepticism about the FBI search leading to successful prosecutions.

“So much this administration has done is to make claims in social media rather than go to court,” Becker said. “I suspect this is more about poisoning the well for 2026.”
