In a case highlighting the damaging impact of online harassment, a woman who made abusive and threatening comments against her former midwife during a social media livestream has been sentenced to 12 months’ supervision in the Dunedin District Court.

Elana Jane Robins displayed her former midwife’s online biography during the stream and made a series of disturbing allegations, including claims that the midwife had been “un-aliving babies.” The court heard that Robins also stated she had the midwife’s address and made threatening statements such as, “You wait till this autopsy comes back, girl… you’re going to have to hide real bad.”

According to the police summary presented in court, these comments not only caused the victim to fear for her safety but also potentially damaged her professional reputation in the healthcare community.

The case comes amid growing concern about online harassment of healthcare professionals, who increasingly face threats and false accusations on social media platforms. Midwives in particular have reported rising incidents of online abuse in recent years, with professional organizations calling for stronger protections against digital harassment.

During the sentencing hearing, defense counsel Rhona Daysh told the court that Robins had since written a letter of apology and expressed genuine remorse for her actions. Judge Robinson acknowledged the apology, noting it “does impress as a general apology,” but emphasized his primary concern was protecting the victim from further harm.

The judge highlighted the particularly troubling nature of social media harassment, pointing out how easily online platforms can be used to influence large audiences and cause widespread damage to individuals’ reputations. While stopping short of implementing a complete ban on Robins’ use of social media, he emphasized that safeguards were necessary.

“This kind of behavior has a really insidious effect, simply because of the reach you have through your audience,” Judge Robinson stated during sentencing. “What you said not only has caused significant emotional impact, it could have had a huge financial impact on the victim as well. Professionals value their reputation.”

The 12-month supervision sentence includes specific conditions requiring oversight of Robins’ use of electronic devices. She must make her devices available to a probation officer upon request and is explicitly banned from making any social media posts or comments about the victim.

The case highlights the growing intersection between online speech and real-world consequences, particularly for healthcare providers whose livelihoods depend on public trust. False accusations spread through social media can rapidly reach thousands of viewers, potentially destroying careers built over decades.

New Zealand’s Harmful Digital Communications Act, passed in 2015, was designed to address exactly this type of online behavior by making it illegal to post digital communication that causes serious emotional distress.
