New York Election Watchdog Warns of Voter Registration Flaws Ahead of November Elections

A nonpartisan election integrity organization is raising alarms about New York State’s failure to implement adequate voting safeguards ahead of the November midterm elections, claiming that millions of voter registrations may contain incomplete information required by federal law.

Restoring Integrity and Trust in Elections (RITE) alleges the New York State Board of Elections (NYSBOE) has stonewalled requests to fix the state’s voter registration form to comply with the Help America Vote Act (HAVA). The organization sent a letter to the board in late 2025 outlining several violations they claim could undermine election integrity if left unaddressed.

After receiving no satisfactory response, RITE, along with Rep. Claudia Tenney (R-N.Y.), is now demanding comprehensive records and data to identify additional shortcomings in the state’s voter registration system.

“Your lack of response is troubling and disregards the need to ensure public trust that New York is maintaining accurate voter rolls as required by federal law,” they wrote in a letter to the NYSBOE this week. The group has set a May 2026 deadline for compliance, after which they warn they are prepared to pursue federal court action.

According to RITE, New York’s voter registration system contains two critical errors that violate federal requirements. First, the state does not properly instruct individuals that they must provide driver’s license information if they have one. Second, the state continues to register individuals who fail to provide a driver’s license number, the last four digits of their Social Security number, or a declaration that they have neither—all required by HAVA.

These violations have potentially significant consequences. A 2022 report from the conservative Public Interest Legal Foundation found that at least 3.1 million New York registered voters have not provided a driver’s license or Social Security number on their application forms, complicating efforts to maintain accurate voter lists.

“The law is clear: states may not accept registration forms that lack required identifying information,” RITE President Justin Riemer said in a statement. “New York’s own regulations direct officials to do exactly that. This flagrant violation of an important federal safeguard significantly erodes the integrity of New York’s voter registration system.”

The situation in New York reflects growing tensions nationwide over election administration as both parties scrutinize voting procedures ahead of the midterms. Election integrity has become a particularly contentious issue following the 2020 presidential election, with Republicans generally pushing for stricter safeguards while Democrats often focus on removing barriers to voting access.

Rep. Tenney, who chairs the Election Integrity Caucus, has been vocal about these concerns since 2022. “Transparency and accurate voter rolls are essential to maintaining public trust in our elections,” the New York Republican said. “The people of New York deserve answers, accountability, and full compliance with HAVA to ensure the integrity of every vote.”

This isn’t the first time New York’s election administration has faced criticism. In February, an employee of the New York City Board of Elections was caught on video declining to block someone posing as a non-citizen from attempting to register to vote, further fueling concerns about inadequate safeguards.

New York’s issues emerge amid broader national debates on election security. The Trump administration recently issued an executive order aimed at overhauling mail-in voting procedures as part of what it describes as an election integrity initiative.

As November approaches, the NYSBOE’s response to these allegations could have significant implications for voter confidence in the electoral process. The board has yet to publicly address RITE’s accusations or outline steps to remedy the alleged violations.
