International Criminal Court Rules Duterte Fit to Stand Trial for Crimes Against Humanity

The International Criminal Court (ICC) ruled Monday that former Philippine President Rodrigo Duterte is fit to stand trial, rejecting concerns about the 80-year-old’s health and setting the stage for a landmark case against the controversial leader.

However, judges rejected the defense team’s argument that this withdrawal invalidated the court’s authority, ruling that countries cannot “abuse” their right to withdraw from the Rome Statute “by shielding persons from justice in relation to alleged crimes that are already under consideration.”

The ICC’s involvement stems from concerns that the Philippine justice system has failed to properly investigate and prosecute those responsible for extrajudicial killings during the anti-drug campaign. Human rights organizations have documented numerous instances of police executing suspects without due process, often in poor urban neighborhoods, under the guise of self-defense.
