ICC Prosecutor Faces Disciplinary Proceedings Amid Sexual Misconduct Allegations
The International Criminal Court’s Chief Prosecutor Karim Khan, who recently brought war crimes charges against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant, is now facing disciplinary proceedings over allegations of sexual misconduct with a subordinate staff member.

Just weeks after these allegations surfaced, Khan filed arrest warrants against Netanyahu and Gallant for alleged war crimes. The timing has raised questions about potential connections between the personal allegations Khan faced and his professional decisions regarding the Israeli officials.
Eugene Kontorovich, a professor at George Mason University, told media outlets that Khan’s attempt to blame Israeli intelligence “shows he is fundamentally compromised” and that in “any normal legal system” the investigation he launched would be “dismissed with extreme prejudice.” Kontorovich characterized the situation as a sign of “how broken” the ICC has become, allowing “such a politicized investigation” to proceed.
The disciplinary vote came despite an earlier finding by three ICC judges who determined there was “insufficient evidence” to prove the allegations against Khan “beyond a reasonable doubt.” Their conclusion was based on a United Nations Office of Internal Oversight Services (OIOS) investigation that produced over 5,000 pages of evidence. While the U.N. investigation had determined Khan engaged in “non-consensual sexual contact” with the employee, the judges found insufficient evidence of misconduct.
In a letter read during the ASP meeting, officials from the prosecutor’s office indicated they did not support Khan remaining in his position as chief prosecutor.
The Association of International Criminal Law Prosecutors (AICLP) has highlighted “structural deficiencies” revealed through these proceedings, particularly criticizing the ICC’s Independent Oversight Mechanism for closing an inquiry when the alleged victim “declined to file a formal complaint” due to fears of retaliation.
“The Court cannot credibly prosecute the gravest crimes against persons while tolerating a culture in which its own staff are inadequately protected,” the AICLP stated in its release.
The AICLP also expressed concern about Khan’s alleged retaliation against staff who supported the complainant. “The standard for fitness to lead the world’s foremost international criminal prosecution office is not simply the absence of proven misconduct beyond reasonable doubt,” the organization noted, adding that it also includes “the demonstrated capacity to command the trust of the institution’s own staff,” which appears “deeply and publicly fractured.”
Peter Gallo, a former OIOS investigator, questioned why Khan should be held to a “ridiculously high standard of proof when lower ranking staff are not.” He also suggested that “trying to deflect attention away from the facts of the allegation by blaming Israel is an indication of the anti-Israel bias which clearly exists, and which reduces the ICC to a tool of political warfare rather than any kind of court of justice.”
The Trump administration sanctioned Khan in February 2025 in response to the war crimes warrants issued against the Israeli officials.
The ICC has not indicated whether investigations into Gallant and Netanyahu would continue if Khan were removed from his position. The disciplinary process is ongoing, with the AICLP calling for “a prompt, principled, and transparent resolution” that they believe is “a prerequisite for restoring the operational integrity” of the prosecutor’s office.
