Australia’s Most Decorated Soldier Arrested for Alleged War Crimes in Afghanistan
Australian authorities have arrested and charged Ben Roberts-Smith, the country’s most decorated living soldier, with five war crime murders allegedly committed during his service in Afghanistan. The 47-year-old former member of the Australian Defence Force was taken into custody at Sydney Airport on Tuesday.
The Australian Federal Police and the Office of the Special Investigator have charged Roberts-Smith in connection with the killings of five unarmed Afghans in three separate incidents between 2009 and 2012. AFP Commissioner Krissy Barrett alleges that Roberts-Smith either killed the unarmed Afghans himself or instructed subordinates to kill them.
“It will be alleged the victims were not taking part in hostilities at the time of their alleged murder in Afghanistan,” Barrett stated during a press conference. “It will be alleged the victims were detained, unarmed and were under the control of ADF members when they were killed.”
If convicted, Roberts-Smith faces life imprisonment on each charge.
The investigation into Roberts-Smith began in 2021, according to Ross Barnett, director of investigations at the Office of the Special Investigator. Barnett acknowledged the significant challenges faced during the investigation, noting that some of the alleged murders occurred more than a decade ago.
“We don’t have access to the crime scenes, we don’t have photographs, site plans, measurements, the recovery of projectiles, blood spatter analysis, all of those things we would normally get at a crime scene,” Barnett explained.
Roberts-Smith received the Victoria Cross, Australia’s highest military honor, after storming two enemy machine gun positions during his fifth tour in Afghanistan. His military career had been widely celebrated until allegations of misconduct began to surface.
The case has sparked significant controversy in Australia. Former Prime Minister Tony Abbott expressed support for Roberts-Smith on social media, questioning why any transgressions weren’t detected earlier by senior officers. Abbott argued it’s unfair to judge “men in mortal combat by the standards of ordinary civilian life.” Tech billionaire Elon Musk also weighed in, describing the arrest as “insane.”
Allegations that Roberts-Smith engaged in war crimes first emerged publicly in 2017 and 2018 through articles published by The Age, the Sydney Morning Herald, and The Canberra Times. Roberts-Smith filed what became Australia’s most expensive defamation suit against these publications, but in 2023, a Federal Court judge ruled that four of the six murder allegations brought by the papers had merit.
One particularly disturbing allegation ruled credible by Justice Anthony Besanko involved Roberts-Smith allegedly marching a handcuffed Afghan man named Ali Jan off a 10-meter cliff. According to court documents, when Jan survived the fall, Roberts-Smith and fellow soldiers walked down to meet him, where Roberts-Smith then ordered a subordinate to shoot him.
The High Court dismissed Roberts-Smith’s appeal of the ruling in September 2025, setting the stage for criminal proceedings.
The charges against Roberts-Smith represent part of a broader investigation into potential war crimes by Australian forces. The joint effort by OSI and AFP has conducted 53 investigations into ADF members tied to war crime allegations in Afghanistan, with ten investigations still ongoing.
