In a significant disciplinary action, the Peshawar High Court (PHC) has suspended the practicing license of an advocate who allegedly spread unsubstantiated claims against members of the judiciary in Swat district, highlighting growing concerns about the misuse of social media to undermine judicial credibility in Pakistan’s Khyber-Pakhtunkhwa province.

Chief Justice SM Atiq Shah, heading a single-member bench of the PHC, ordered the immediate suspension of Liaqat Ali, a member of the Tehsil Bar Kabal, after determining that the lawyer had engaged in what the court characterized as “negative propaganda” against judicial officers. The court’s written order, issued Thursday, also banned Ali from entering any court premises and prohibited him from pursuing or appearing in legal cases until further notice.

The case stems from a video that Ali reportedly circulated on social media platforms containing serious allegations against members of the Swat district judiciary. The content quickly went viral, prompting the high court to take suo motu notice of the situation, a relatively rare move that underscores the perceived severity of the misconduct.

As part of its investigation, the court appointed Additional District and Sessions Judge Naser Khan to conduct a thorough inquiry into the claims. According to court documents, the inquiry revealed that Ali failed to substantiate his allegations with any evidence. Notably, the advocate could not even identify which specific judicial officer was the target of his claims, further undermining the credibility of his accusations.

“The said advocate took this step merely to pressurize judicial officers, which falls under the category of misconduct,” the court stated in its ruling. Based on these findings, the PHC forwarded the case to the Chairman of the Khyber-Pakhtunkhwa Bar Council for further disciplinary proceedings, indicating that additional sanctions may be forthcoming.

This case highlights the increasing tensions between social media expression and professional conduct in Pakistan’s legal community. While advocates traditionally enjoy certain immunities to speak freely in defense of their clients, courts across Pakistan have been increasingly vigilant about policing what they view as attempts to undermine judicial independence or integrity through digital platforms.

The Swat district, located in the northern part of Khyber-Pakhtunkhwa province, has faced significant challenges in maintaining rule of law over the past decade. After periods of militant control and subsequent military operations, the restoration of judicial authority has been a critical component of reestablishing government control in the region. Attacks on judicial credibility, whether physical or rhetorical, are therefore treated with particular seriousness.

Legal experts note that while the right to criticize judicial decisions is fundamental to a functioning democracy, making unsubstantiated allegations against judicial officers crosses professional boundaries. The Pakistan Bar Council and provincial bar associations have ethical codes that require advocates to maintain respect for courts while pursuing legitimate grievances through proper channels.

This case also reflects broader concerns about the spread of misinformation on social media platforms in Pakistan, which has prompted various regulatory efforts in recent years. The Pakistan Electronic Crimes Act, enacted in 2016, includes provisions against defamation and spreading false information that can be applied to cases involving digital content.

The suspension of Ali’s license serves as a reminder to legal professionals throughout Pakistan that while they have special standing to represent their clients and advocate for justice, they remain subject to professional ethical standards that prohibit undermining the judiciary through unsubstantiated claims.

The Khyber-Pakhtunkhwa Bar Council is expected to conduct its own proceedings in the matter, which could result in the temporary suspension becoming permanent or in other disciplinary measures being imposed on the advocate.
