President Trump has criticized the Supreme Court’s liberal justices while praising conservative dissenters following a significant ruling that blocked his use of emergency powers to impose sweeping tariffs on trading partners.

In a White House press conference held hours after the 6-3 Supreme Court decision, Trump acknowledged what he called the “loyalty” of the Court’s three liberal justices—Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson.

“The Democrats on the court are thrilled, but they will automatically vote no,” Trump said. “Just like in Congress, they’re an automatic no. They’re against anything that makes America strong, healthy and great again.”

While critical of the liberal justices, Trump expressed admiration for the three conservative justices who dissented: Clarence Thomas, Samuel Alito, and Brett Kavanaugh.

“I’d like to thank and congratulate Justices Thomas, Alito and Kavanaugh for their strength and wisdom and love of our country, which is right now very proud of those justices,” Trump stated. “When you read the dissenting opinions, there’s no way that anyone can argue against them.”

The case centered on Trump’s use of the International Emergency Economic Powers Act (IEEPA), a 1977 law that allows presidents to restrict certain international economic transactions after declaring a national emergency related to a foreign threat. The Court ruled that this statute does not authorize the imposition of tariffs in the manner Trump had implemented them.

Justice Kavanaugh authored the main dissent, arguing that presidents have historically imposed tariffs to regulate imports. He warned of “serious practical consequences” from the ruling, particularly regarding the potential refund of billions of dollars to importers who paid the IEEPA tariffs.

“As was acknowledged at oral argument, the refund process is likely to be a ‘mess,'” Kavanaugh wrote in his dissent.

Tariffs have been a cornerstone of Trump’s economic policy since taking office. His administration has consistently argued that they generate significant revenue from foreign nations that have been “ripping off” the United States for decades. The White House has also maintained that tariffs encourage both foreign businesses and American companies to establish operations on U.S. soil to avoid these taxes, thereby creating American jobs and strengthening domestic manufacturing.

Despite the setback, Trump emphasized that the ruling “did not overrule tariffs, but merely overruled a particular use of IEEPA tariffs.” He quickly announced plans to implement alternative approaches to his trade policies.

“Other alternatives will now be used to replace the ones that the court incorrectly rejected,” Trump declared. “We have alternatives. Great alternatives. Could be more money. We’ll take in more money, and we’ll be a lot stronger for it.”

As an immediate response, Trump announced he would sign an order imposing a 10% global tariff under Section 122 of the Trade Act of 1974, which provides the president with authority to address balance of payment deficits. This would be applied “over and above our normal tariffs already being charged,” according to Trump.

The president also announced the initiation of several Section 301 investigations, which allow the U.S. Trade Representative to respond to foreign trade practices deemed unfair to American commerce.

The ruling represents a significant limitation on presidential authority to unilaterally impose trade barriers through emergency powers, though Trump appears determined to pursue his tariff agenda through alternative legal mechanisms.
