Arizona Senate President Hands Election Records to FBI, Renewing 2020 Election Scrutiny

Arizona Senate President Warren Petersen confirmed Monday that he has surrendered records related to the controversial 2020 presidential election audit to the FBI, complying with a federal grand jury subpoena received “late last week.”

“The FBI has the records,” Petersen stated in a brief social media post, offering no additional details about the scope of the request or the specific documents provided. Neither Petersen nor Senate Republican representatives offered further comment when contacted, and the FBI’s Phoenix office has not yet responded to inquiries.

This development marks the second instance this year of federal authorities obtaining 2020 election materials from key battleground states. In January, FBI agents seized ballots and other election documentation from Georgia’s Fulton County after securing a search warrant. That request was reportedly based on years-old claims previously investigated and found unconnected to widespread fraud.

The methods used to obtain records differed between states. In Georgia, authorities secured a judicial search warrant requiring probable cause of a crime, while in Arizona, they employed subpoenas, which don’t require judicial approval or assertions of criminal activity.

Arizona Attorney General Kris Mayes responded sharply to Petersen’s announcement, emphasizing that multiple audits, independent investigations, and legal challenges had thoroughly debunked claims of significant fraud in the 2020 presidential election.

“Warren Petersen knows all of this. He has known it for years. He spread false stories of election fraud in 2020, and he remains an unrepentant election denier,” Mayes said. “What the Trump administration appears to be pursuing now is not a legitimate law enforcement inquiry. It is the weaponization of federal law enforcement in service of crackpots and lies.”

The original audit, conducted in 2021 by the firm Cyber Ninjas at Republican lawmakers’ request, was widely criticized by election experts for methodological flaws and bias. The six-month process explored numerous conspiracy theories, including examining ballots for bamboo fibers to investigate baseless claims they were imported from Asia.

Despite extensive scrutiny, the audit failed to produce evidence supporting former President Trump’s claims of election fraud. In fact, it concluded that Joe Biden received 360 more votes than originally reported in Maricopa County’s certified results. Cyber Ninjas acknowledged finding “no substantial differences” between their hand count and official tallies.

Multiple previous reviews of Maricopa County’s 2.1 million ballots by nonpartisan professionals following state law had already confirmed the integrity of the 2020 election. Biden won the Republican-controlled county by 45,000 votes and Arizona overall by 10,500 votes.

Arizona Secretary of State Adrian Fontes, a Democrat, expressed concern that voter data may have been included in the records Petersen provided to the FBI. “This could be an end run by the Department of Justice to obtain unredacted voter files,” suggested Calli Jones, a spokesperson for Fontes’s office, which is now “assessing what was released” and “considering legal options to secure personal voter information in the 2020 data that was shared.”

This investigation comes amid broader tensions between the Justice Department and several states over access to detailed voter information, including names, birth dates, addresses, and partial Social Security numbers. Arizona is among states the department has sued to obtain such data. Election officials have raised concerns about potential violations of data privacy laws and fears the information could be used to purge voter rolls.

The continued scrutiny of the 2020 election, now approaching four years after Biden’s victory, underscores the persistent political divisions surrounding electoral processes and the ongoing impact of Trump’s unsubstantiated claims of a stolen election. Despite exhaustive investigations finding no evidence of widespread fraud, these claims continue to influence political discourse and governmental actions in battleground states like Arizona.
