Texas Congressman Proposes Enhanced Protections for Border Patrol Officers Assisting Local Law Enforcement

Rep. Tony Gonzales, R-Texas, is pushing legislation to strengthen legal protections for U.S. Customs and Border Protection (CBP) personnel when they assist state and local law enforcement agencies outside their primary jurisdiction.

The Homeland Threat Response Act, introduced by Gonzales in January, would amend the 2002 Homeland Security Act to formally authorize CBP deployment for investigations of violent acts, shootings, mass killings and major events. The legislation specifically addresses elite units within Border Patrol’s Special Operations Group (SOG), including BORTAC (Border Patrol Tactical Unit) and BORSTAR (Border Patrol Search, Trauma, and Rescue).

“They’re doing so at a risk,” Gonzales told Fox News Digital, explaining that these specialized personnel currently lack the same legal protections as other law enforcement officers when operating beyond their primary duties. “This creates a level playing field when it comes to protection.”

The timing of the legislation is particularly relevant as the United States prepares to host several major international sporting events. Super Bowl LX will be played this Sunday in Santa Clara, California, while multiple American cities will host FIFA World Cup matches in July. Additionally, Los Angeles is preparing to host the 2028 Summer Olympics.

“It’s going to be this group that’s going to keep us safe,” Gonzales emphasized, referring to the elite Border Patrol units that would provide security support at these high-profile events.

The Border Patrol’s Special Operations Group has a track record of supporting or directly participating in major domestic incidents, including responding to mass shootings and assisting in the capture of criminal illegal immigrants and escaped prisoners. These highly trained units represent some of the most specialized law enforcement personnel in the federal system.

Gonzales expressed concern about what he views as partisan resistance to the measure, particularly in light of discussions among some Democratic lawmakers about defunding the Department of Homeland Security. These calls have intensified in certain regions, notably Minnesota, following the previous administration’s immigration enforcement policies.

“I’m seeing Democrats cave to the liberal left that want to defund and want to make it harder for law enforcement to do its job,” Gonzales stated. He argues that his legislation would allow federal officers to focus entirely on their mission without worrying about potential legal vulnerabilities.

The bill comes amid broader debates about immigration enforcement and the role of federal agencies in supporting local law enforcement. Border security remains a divisive political issue, with Republicans generally advocating for stronger enforcement measures while some Democrats have called for reforms to immigration policy and border operations.

The proposed legislation addresses a specific operational gap in current law. When CBP personnel, particularly specialized tactical units, are requested to assist in local emergencies or high-risk operations, they may operate without the same legal protections afforded to them during their standard border security duties or to other law enforcement officers in similar situations.

Security experts note that the cross-jurisdictional cooperation between federal, state and local law enforcement has become increasingly important in addressing complex threats like terrorism, mass shootings, and organized crime. The clear delineation of legal protections across these jurisdictional boundaries represents a significant challenge for law enforcement agencies.
