Immigration Arrest of NYC Council Employee Sparks Outrage and Legal Challenge
A New York City Council employee who was detained during the Trump administration’s immigration enforcement actions is a Venezuelan asylum-seeker, according to court documents filed seeking his release.
Rafael Andres Rubio Bohorquez, who works as a data analyst for the city’s legislative body, was arrested Monday during what officials described as a routine immigration check-in at a U.S. Citizenship and Immigration Services asylum office in Bethpage, Long Island. The arrest has ignited fury among city leaders and drawn protesters to the Manhattan federal building where he is being held.
U.S. Immigration and Customs Enforcement (ICE) claims Rubio Bohorquez had overstayed a tourist visa that expired in October 2017, had previously been arrested for assault, and “had no legal right to be in the United States.” The agency further stated he lacked proper work authorization.
City Council Speaker Julie Menin strongly disputed these assertions, telling reporters that Rubio Bohorquez was legally authorized to work in the United States until October of this year. Menin, a Democrat, explained that the council employee had signed documentation confirming he had never been arrested and had successfully cleared the standard background check required for all applicants.
“We are doing everything we can to secure his immediate release,” Menin told reporters, describing the arrest as “egregious government overreach.”
The habeas corpus petition filed on Rubio Bohorquez’s behalf by the New York Legal Assistance Group directly contradicts ICE’s claims, stating he has no criminal record whatsoever – no arrests, charges, or convictions. The petition identifies him only by his initials, R.A.R.B., noting he has consistently been seeking asylum in the United States.
Lisa Rivera, president and CEO of the New York Legal Assistance Group, defended Rubio Bohorquez in a statement: “This staffer, who chose to work for the city and contribute his expertise to the community, did everything right by appearing at a scheduled interview, and yet ICE unlawfully detained him.”
The organization represents dozens of people allegedly wrongfully detained by ICE and hundreds of others following proper immigration procedures while attempting to remain in the country legally.
According to city payroll data, Rubio Bohorquez has been employed by the City Council for approximately one year in a position that pays about $129,315 annually.
New York City Mayor Zohran Mamdani expressed outrage, calling the arrest “an assault on our democracy, on our city, and our values.” Governor Kathy Hochul referenced the incident during her state of the state speech on Tuesday, questioning whether Rubio Bohorquez truly represented the “baddest of the bad” or posed any genuine threat.
“I will do whatever it takes to protect New Yorkers from criminals, but people of all political beliefs are saying the same thing about what we’ve seen lately: Enough is enough,” Hochul stated.
The arrest has mobilized protesters, with several dozen gathering outside the Greater New York Federal Building where Rubio Bohorquez is being held. Some carried signs with messages such as “Abolish ICE” and “No Human Is Illegal.”
This case unfolds against the backdrop of the ongoing Venezuelan refugee crisis. Nearly 8 million people have fled the South American nation since 2014, according to United Nations data, amid years of violence and economic instability. The situation was further complicated last year when the Trump administration ended Temporary Protected Status that had allowed hundreds of thousands of Venezuelan refugees to live and work in the United States without fear of deportation.
ICE, operating under the Department of Homeland Security, maintained a hard-line stance in its statement confirming Rubio Bohorquez’s arrest, stating that under Secretary Kristi Noem, “criminal illegal aliens are not welcome in the United States. If you come to our country illegally and break our law, we will find you and we will arrest you.”
A hearing on the petition for Rubio Bohorquez’s release is scheduled for Friday.
