New York and New Jersey Sue Trump Administration Over Frozen Hudson Tunnel Funding

New York and New Jersey filed a lawsuit Tuesday against the Trump administration for cutting off $16 billion in federal funding for the Gateway project, a critical rail tunnel construction effort under the Hudson River that connects the two states.

The legal action, filed in the Southern District of New York, accuses the federal government of “illegally withholding” previously committed funding for the infrastructure project. With construction already underway for over a year, state officials are seeking emergency relief to force the release of funds, warning that the project could shut down as early as Friday if the situation isn’t resolved.

“Donald Trump’s revenge tour on New York threatens to derail one of the most vital infrastructure projects this nation has built in generations, putting thousands of union jobs and billions of dollars in economic benefits in jeopardy and threatening the commutes of 200,000 riders,” New York Governor Kathy Hochul said in a statement.

The funding freeze occurred during the government shutdown last fall, affecting not only the Gateway project but also the extension of New York City’s Second Avenue Subway. State officials have characterized the move as politically motivated rather than fiscally necessary.

The Gateway project represents a crucial infrastructure update for the Northeast Corridor, one of the nation’s busiest transportation regions. The planned construction would create new tunnels and rehabilitate the existing Hudson River rail crossing, which is more than 115 years old and suffered severe damage from saltwater flooding during Hurricane Sandy in 2012.

Transportation experts have long warned about the deteriorating condition of the current tunnels. According to Amtrak, which operates the Northeast Corridor, failure of just one tunnel could reduce rail traffic into New York City by up to 75%, creating a transportation crisis for the approximately 70,000 New Jersey commuters who use the crossing daily.

New Jersey Governor Mikie Sherrill echoed Hochul’s concerns, stating: “Every time the Trump Administration gets involved, costs go up and working people suffer. The illegal attack on the Gateway Tunnel is yet another example.” She emphasized that an immediate halt to the project would result in job losses for approximately 1,000 workers and impact the transit reliability for hundreds of thousands of commuters.

The infrastructure project has broader economic implications for the entire Northeast region. The existing rail tunnels serve as a critical artery for both commuter and intercity rail service, connecting major economic centers along the Eastern Seaboard. Any disruption to this service could have ripple effects throughout the regional economy.

Jennifer Davenport, New Jersey’s acting attorney general, emphasized the states’ commitment to protecting residents from what they view as an unlawful action. “The Federal Government has left us no choice: we must challenge this illegal action in court, and demand emergency relief that will protect us from these unlawful harms,” she said.

The Gateway Development Commission, the entity overseeing the project, filed a separate lawsuit against the federal government on Monday over the funding dispute.

The legal battle unfolds against the backdrop of broader tensions between the Trump administration and Democratic-led states. Both New York and New Jersey have clashed with the federal government on numerous policy issues, from immigration to environmental regulations.
