Minnesota Faces Federal Ultimatum Over Childcare Fraud Investigation

Federal officials have ramped up pressure on Minnesota to comply with demands for documentation amid an ongoing investigation into alleged childcare fraud in the state.

The Department of Health and Human Services (HHS) has issued a “preliminary notice of non-compliance” after officials claim the state failed to provide requested evidence that childcare funding is going to legitimate providers.

“We asked Minnesota for evidence that child care funding goes to legitimate providers,” Jim O’Neill, HHS deputy secretary, said in a recent video statement. “Six weeks later, they still have not sent this information. We are no longer asking, we are demanding.”

The ultimatum comes after federal officials froze childcare payments to Minnesota on December 30 following allegations of widespread fraud involving daycare centers. According to O’Neill, the state has 60 days to provide the required documentation or face “full penalties under the law.”

“Every dollar that the state diverts into fraud is stolen from the intended Minnesota recipient,” O’Neill stated. “The status quo was to trust the state to stop fraud. That clearly did not work.”

The investigation began after media reports revealed allegations that inactive daycare centers were receiving millions in government funding. Federal officials have specifically requested comprehensive audits of certain daycare centers, including attendance records, licenses, complaints, investigations and inspection records.

HHS sends approximately $20 billion annually to Minnesota for various programs. The Administration for Children and Families (ACF), an HHS division, now has a team conducting an on-site monitoring visit in the state to gather records that officials claim Minnesota has failed to provide.

Minnesota Governor Tim Walz’s office has pushed back against the investigation, suggesting it is politically motivated. A spokesperson for Walz told Fox News in December, “Fraud is a serious issue. But this is a transparent attempt to politicize the issue to hurt Minnesotans and defund government programs that help people.”

The dispute highlights growing tension between federal and state authorities over program oversight and accountability. Federal officials maintain they are pursuing “every credible lead” to restore program integrity.

The Quality Learning Center in Minnesota has been identified as central to the alleged fraud scheme, though specific details of the allegations have not been fully disclosed in public statements from federal officials.

This investigation comes amid increased federal scrutiny of social service funding across multiple states. Some House Republicans have characterized the Minnesota probe as “the tip of the iceberg,” suggesting similar investigations could target other states.

If Minnesota fails to satisfy federal demands, the state could face substantial financial penalties that would impact its ability to administer various health and human services programs.
