ICE Issues Detainer for Illegal Migrant Charged with Soliciting Sexual Content from Children

The Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) have lodged an arrest detainer for Angel David Rubio Marin, a Mexican national who allegedly used the popular gaming platform Roblox to solicit sexual content from children under 10 years old.

According to authorities, Rubio Marin enticed at least three young children to send him sexually explicit videos and images by offering “Robux,” the in-game currency used on the Roblox platform. The suspect was arrested in Prince William County, Virginia.

Court records show that Rubio Marin had previously faced charges of public masturbation but was released prior to the current allegations. The timing of his release has ignited criticism from federal immigration officials, who point to the case as evidence of problematic sanctuary policies.

“This sicko preyed on innocent children by offering to pay them in a video game currency in exchange for child pornography,” said Acting Assistant Secretary Lauren Bis in a statement. “This illegal alien was released from jail after an arrest for public masturbation. This case is a perfect example of why we need state and local cooperation with ICE.”

Federal officials confirmed that Rubio Marin entered the United States illegally, though the specific time and location of his entry remain unknown.

The case has become a flashpoint in the ongoing debate over immigration enforcement policies, particularly in Virginia. DHS officials have directed criticism at Virginia Governor Abigail Spanberger, who signed an executive directive in February ending the state’s cooperation with federal immigration authorities.

Spanberger’s directive reversed the 287(g) program that had been implemented under former Republican Governor Glenn Youngkin. That program had allowed certain local law enforcement officers to perform limited immigration enforcement duties under ICE supervision, including identifying illegal immigrants being held in local jails and preventing the release of those with criminal records back into communities.

In explaining her policy shift, Spanberger argued that requiring state and local officers to handle federal immigration duties diverts them from their primary responsibilities. She maintained that such policies can damage community relationships and create an atmosphere of fear that ultimately hinders effective policing.

“We are calling on Virginia sanctuary politicians and Governor Spanberger to commit to not releasing this child predator back into Virginia neighborhoods,” Bis added. “No one wants this pedophile loose on American streets.”

The gaming platform Roblox, which has surged in popularity among children and young teens in recent years, clarified that their platform’s filters make it impossible for users to share images or videos through in-game chat. This suggests that the alleged solicitation may have occurred through external communication after initial contact was made through the game.

Roblox has become one of the most widely used gaming platforms globally, particularly among children, with over 70 million daily active users. The platform allows users to create and play games created by other users and interact through various features, including a chat function.

The case highlights ongoing tensions between federal immigration authorities and states with sanctuary-style policies. Critics of these policies argue they allow dangerous individuals to evade deportation and potentially reoffend, while supporters maintain they foster trust between immigrant communities and local law enforcement.

As of publication, Governor Spanberger’s office has not responded to requests for comment on the case or the criticism from federal immigration authorities.
