After months of legal battles, Salvadoran immigrant Kilmar Abrego Garcia will spend Christmas with his family following a recent court ruling that prevents his immediate return to immigration custody.
U.S. District Judge Paula Xinis issued an order Monday requiring government attorneys to file a brief by December 26 detailing whether they plan to take Abrego Garcia back into immigration detention and what legal authority they would use to do so. His attorneys have until December 30 to respond, while a temporary restraining order blocking Immigration and Customs Enforcement (ICE) from detaining him remains in effect.
“This decision means Kilmar gets to sleep in his own bed in the next coming days, without the fear of being separated from his family and community in the middle of the night,” said Lydia Walther-Rodriguez, an organizer with the community advocacy group CASA.
Abrego Garcia’s case has become a flashpoint in America’s contentious immigration debate. Despite having no criminal record, Trump administration officials have accused him of being a member of the MS-13 gang—allegations he has consistently denied. The Salvadoran immigrant has established deep roots in Maryland, where he lives with his American wife and child, though he originally entered the United States illegally as a teenager.
In 2019, an immigration judge granted Abrego Garcia protection from deportation after determining he faced serious dangers in El Salvador from a gang that had targeted his family. Despite this ruling, he was mistakenly deported to El Salvador in March 2023, where he was subsequently imprisoned.
Following public pressure and a court order, the Trump administration returned Abrego Garcia to the United States in June. However, authorities immediately issued an arrest warrant charging him with human smuggling in Tennessee. He has pleaded not guilty to these charges and has asked the judge to dismiss them.
After his return to the U.S., Abrego Garcia spent two months in a Tennessee jail before being temporarily released to his family in Maryland. His freedom was short-lived—ICE detained him again after just one weekend. Trump administration officials have maintained that he cannot remain in the country.
In recent months, government attorneys have threatened to deport Abrego Garcia to various countries including Uganda, Eswatini, Ghana, and most recently, Liberia. Notably, officials have made no effort to send him to Costa Rica—the one country where he has agreed to go. Judge Xinis has criticized the government for misleading the court by falsely claiming that Costa Rica was unwilling to accept him.
The legal standoff reached another turning point on December 11, when Judge Xinis ordered Abrego Garcia’s release from ICE custody. Her ruling stated that the government had no viable deportation plan and could not keep him detained indefinitely.
The case highlights ongoing tensions in U.S. immigration policy, particularly regarding individuals with mixed immigration status families and those seeking protection from violence in their home countries. Advocates argue that Abrego Garcia’s treatment demonstrates flaws in the immigration enforcement system, while administration officials maintain they are upholding immigration laws.
As the legal process continues, Abrego Garcia’s situation remains precarious. The upcoming court filings will determine whether the government can establish legal grounds to return him to detention or whether he will be permitted to remain with his family while his immigration case proceeds.
For now, the ruling represents a temporary victory for Abrego Garcia and his supporters, allowing him to spend the holiday season with his family while the complex legal questions surrounding his case continue to unfold in the federal court system.
