Indian authorities announced on Tuesday a significant tightening of regulations for social media companies, mandating that unlawful content must be removed within three hours of notification—a dramatic reduction from the previous 36-hour timeline. This change poses a substantial compliance challenge for major platforms including Meta, YouTube, and X.

The amended rules, set to take effect on February 20, represent the latest modification to India’s 2021 IT regulations, which have already been a contentious issue between Prime Minister Narendra Modi’s government and global technology firms.

In a slight concession to industry concerns, the government relaxed an earlier proposal regarding AI-generated content. Rather than requiring platforms to visibly label such content across 10 percent of its surface area or duration, the new rules simply require that AI content be “prominently labelled”—giving platforms some flexibility in implementation.

Digital rights advocates have criticized India’s increasingly strict content takedown regime, viewing the shortened timeline as part of a broader effort to control online speech. The three-hour window creates substantial operational challenges for platforms that must review potentially millions of takedown requests while maintaining adequate human oversight of automated systems.

The regulatory shift comes amid escalating tensions between the Indian government and major tech companies. Elon Musk’s X (formerly Twitter) has already experienced significant clashes with Indian authorities over content moderation policies. Just last year, the platform faced several compliance notices and legal threats when it failed to remove content the government deemed problematic within specified timeframes.

Industry analysts suggest the compressed timeline may force companies to either significantly expand their content moderation teams in India or implement more aggressive automated filtering systems that could risk removing legitimate speech in an effort to avoid penalties.

“This puts platforms in an impossible position,” said a technology policy expert who requested anonymity due to the sensitivity of the issue. “Three hours is barely enough time for proper review of complex cases, especially during periods of high volume or outside business hours.”

For Meta, which operates Facebook, Instagram, and WhatsApp—all hugely popular services in India with hundreds of millions of users—the new regulations present particular challenges given the scale of content shared across its platforms. The company declined to comment on the changes when contacted.

Google’s YouTube and X did not immediately respond to requests for comment on how they plan to meet these tightened requirements.

India represents one of the largest markets globally for most social media platforms, with over 800 million internet users and rapidly growing digital adoption. This market importance has historically made tech companies reluctant to directly challenge government regulations, despite concerns about implementation difficulties or potential impacts on freedom of expression.

The amended rules also come as governments worldwide grapple with regulating online content, particularly as AI-generated material becomes increasingly sophisticated and difficult to distinguish from human-created content. India’s approach to AI labeling requirements will likely be watched closely by other jurisdictions considering similar regulations.

Legal experts note that while the government has legitimate interests in addressing harmful content, the compressed timeline risks undermining due process in content moderation decisions and could lead to overcorrection by platforms seeking to avoid penalties.

As the February 20 implementation date approaches, technology companies are expected to engage in last-minute consultations with government officials while rapidly adjusting their internal processes to meet the new requirements.
