The owner of a medical facility in Troy who was previously charged in connection with the death of a 5-year-old boy in a hyperbaric chamber explosion is now facing additional health care fraud charges, according to Michigan authorities.

Tamela Peterson, 59, of Brighton, has been charged with nine counts of Health Care Fraud – False Claim, Michigan Attorney General Dana Nessel announced yesterday. These charges come as Peterson already faces second-degree murder charges related to the January 2023 death of Thomas Cooper at The Oxford Center in Troy.

The incident occurred when a hyperbaric chamber at the facility exploded while Cooper was inside receiving treatment. The tragedy prompted a thorough investigation into Peterson’s operations and business practices.

According to the attorney general’s office, Peterson operated both The Oxford Recovery Center in Brighton and The Oxford Center in Troy, facilities that provided alternative treatments for patients with various medical conditions. Hyperbaric oxygen therapy, which involves breathing pure oxygen in a pressurized environment, is sometimes used as a treatment for certain medical conditions, though its applications and efficacy remain controversial for some uses.

Prosecutors allege that Peterson knowingly benefited from fraudulent health care claim practices, including billing insurance companies for services that were never actually provided to patients. These allegations suggest a pattern of financial misconduct that extended beyond the safety issues that led to Cooper’s death.

The fraud investigation began in September 2022, several months before the fatal explosion, after authorities received complaints from former employees and patients of Peterson’s facilities. The timing indicates that concerns about the centers’ practices existed prior to the tragedy that claimed Cooper’s life.

“Filing false claims impacts not only patients and providers, but also contributes to increased costs of healthcare and medical insurance for everybody,” Nessel said in a statement. “Health care fraud undermines the trust between patients and providers and patients’ notions of confidentiality and care. My office will continue to hold accountable those who take advantage of their practice for their own financial benefit.”

The case highlights growing concerns about regulation and oversight in the alternative medicine industry, particularly for treatments that utilize potentially dangerous equipment like pressurized chambers. Hyperbaric oxygen therapy, while legitimate for certain medical conditions, has also become popular in some alternative medicine circles for uses not always supported by scientific evidence.

The fraud charges against Peterson reflect a broader trend of increased scrutiny on health care billing practices across the medical industry. In recent years, federal and state authorities have intensified efforts to combat health care fraud, which costs the U.S. healthcare system billions of dollars annually.

For Peterson, these new fraud charges compound her legal troubles as she still faces the second-degree murder charges related to Cooper’s death. The murder charges suggest prosecutors believe Peterson’s actions or negligence directly contributed to the fatal explosion.

The case has drawn significant attention in Michigan, not only due to the tragic death of a child but also because it raises questions about safety standards and business practices in facilities offering alternative medical treatments. As the legal proceedings continue, the case may lead to calls for stronger regulation of such facilities and the treatments they offer.

State records indicate four people in total were arrested in connection with the hyperbaric chamber explosion, though details about the others charged have not been fully disclosed in recent reports.

As the case moves through the court system, it could potentially set precedents for how similar facilities are regulated and how responsibility is assigned when treatments result in injury or death.
