Josh Duggar Defends Brother from Prison as Joseph Faces Child Molestation Charges

According to the Bay County Sheriff’s Office in Florida, the case originates from a 2020 incident in Panama City Beach during a family vacation. The girl, who was nine years old at the time, later reported that Joseph asked her to sit on his lap and “grazed her genitals” under a blanket. Investigators say she told them the incidents ceased that same year after Joseph apologized.
Josh’s intervention came through two separate statements issued by his legal team. In remarks to Us Weekly on March 20, his attorney said Josh “does not know the details of the claims that have been made against his brother” but understands the impact of public scrutiny on the family.
“He feels for his brother because everything is amplified out of proportion by the media interest in his family. This makes the pain of the criminal justice process exponentially worse,” the lawyer stated. “Josh prays for his brother and he hopes that he can stay strong. He too has felt the crushing wave of accusation that is powered by the media spectacle to which his family is subjected.”
In earlier comments to the Daily Mail, Josh’s attorney said he was “deeply saddened” to learn of the charges against Joseph and went further in challenging the allegations. “Josh understands the stigma of being accused. He lives with the painful reality of how false accusations can destroy a life. He understands how the targeting of a person for publicity can twist the truth into sensationalized fiction.”
The legal team also noted that “Josh and Joe are not in frequent communication,” suggesting distance between the brothers despite Josh’s public defense.
Law enforcement officials tell a different story. Police say the case resurfaced when the girl’s father confronted Joseph earlier this month. Investigators state that Joseph admitted to his behavior both to the father and to detectives from the Tontitown Police Department.
Joseph Duggar, 31, who is married with four children, now faces charges of lewd and lascivious behavior involving a victim under 12 and unlawful sexual activity with a minor.
The allegations have created visible fractures within the extended Duggar family. Jill Duggar Dillard, one of the more outspoken siblings in recent years, released a statement with her husband Derick saying they were “shocked and heartbroken” when they learned of Joseph’s arrest from a friend’s text message about media reports and an alleged confession.
“We strongly condemn abuse. We support the rule of law and hope that justice will be achieved,” their statement read. “Our hearts go out to the innocent juvenile victim of this unspeakable crime and her family. We pray God gives her strength, comfort and hope, and that she is able to get all the help and support she needs and deserves in the days ahead.”
Jill and Derick also expressed sympathy for Joseph’s wife, Kendra, acknowledging “the indescribable pain” she and their children must be experiencing.
The case carries a particular irony as Joseph had previously commented publicly on Josh’s misconduct. In a 2015 episode of the Duggar spin-off “Counting On,” filmed after revelations that Josh had molested five girls as a teenager, including four of his sisters, Joseph said it “broke my heart” to learn that someone he respected had been “living such a secret life.”
Josh remains in prison following his 2021 conviction for receiving and possessing child sexual abuse material, though the possession count was later vacated. He is scheduled for release in October 2032, after which he will serve 20 years of supervised release. Despite maintaining his innocence and filing multiple appeals, all have been denied thus far.
