The footage captured a scene where a man appeared to lose consciousness while holding a child as US Immigration and Customs Enforcement (ICE) officers attempted to detain a woman in their vehicle last Thursday.

The dramatic video, first obtained by the Boston Globe, shows a woman frantically trying to rouse the unresponsive man in the driver’s seat as a crying child sits between them. Bystanders can be heard shouting “He’s having a seizure,” while ICE agents attempt to remove the passengers from the vehicle and repeatedly order onlookers to “back up.” One witness is heard claiming, “They’re trying to rip the baby out of his hand.”

The Department of Homeland Security (DHS) has pushed back strongly against the narrative surrounding the video, calling it “misleading” and incomplete. In a statement released Friday, DHS officials identified the woman being arrested as Juliana Milena Ojeda-Montoya, a 26-year-old Ecuadorian national they described as an undocumented immigrant with a pending criminal case.

According to DHS, Ojeda-Montoya is accused of “repeatedly stabbing a coworker with scissors and then throwing a trash can at her victim” in an August incident. This information, they claim, provides critical context missing from the viral footage that has circulated online.

DHS explained that ICE officers were conducting a “targeted operation” to arrest Ojeda-Montoya when the incident occurred. Her husband, Carlos Zapata Rivera, and their young child were in the vehicle at the time of the arrest. The agency noted that the child was sitting on the mother’s lap rather than in a proper car seat.

The sequence of events, as described by DHS, differs significantly from what some observers initially interpreted from the video. Officials claim that when officers informed Ojeda-Montoya of the arrest warrant, they requested she hand over the child to her husband. According to DHS, she refused until Zapata Rivera “pretended to have a medical episode.”

DHS officials said ICE agents immediately called 911, but when emergency responders arrived, they found “no legitimate medical concerns.” The agency added that Zapata Rivera declined medical treatment and was observed to be “coherent and on his feet moments later.”

Assistant Secretary Tricia McLaughlin accused media outlets of spreading a “FALSE narrative about our brave ICE law enforcement officers.” She stated, “As usual, here’s the REAL story: ICE targeted a known criminal who repeatedly stabbed her coworker. Medical personnel found there was no legitimate medical emergency.”

McLaughlin further claimed that both parents initially told officers they were willing to let the child be placed in state custody. However, Zapata Rivera ultimately left with the child after allegedly realizing he could face immigration charges if he refused, according to the DHS statement.

During the confrontation, DHS claimed a “crowd of agitators” gathered and shouted obscenities, threats, and even antisemitic remarks at the ICE officers, further complicating an already tense situation.

Additional background provided by DHS indicates that both Ojeda-Montoya and Zapata Rivera were apprehended by US Border Patrol near Lukeville, Arizona, in February 2023. They were subsequently released into the United States the following month under Biden administration policies.
