In a significant turnaround, two Immigration and Customs Enforcement (ICE) agents have been suspended and are under criminal investigation after allegedly lying under oath about the shooting of a Venezuelan immigrant in Minnesota last month. Federal assault charges against two Venezuelan men have been dismissed with prejudice, meaning they can never be charged again in relation to the incident.

The case began on January 14 when ICE agents claimed that Julio Cesar Sosa-Celis and his cousin Alfredo Alejandro Aljorna attacked them with a snow shovel and a broom after a traffic stop, forcing one of the officers to fire in self-defense. Homeland Security Secretary Kristi Noem initially characterized the incident as an “attempted murder” of federal law enforcement officers.

However, video evidence later emerged directly contradicting these claims. Sosa-Celis maintained that he had retreated into his home and was shot in the leg while closing and locking his door. On Thursday, a federal judge dismissed all felony assault charges against both men after prosecutors acknowledged that newly discovered evidence contradicted the officers’ testimony.

Frederick Goetz, the criminal defense attorney representing Aljorna, described what actually happened according to his client’s account: “He was on his way home—he’s a DoorDash delivery person—and he was followed by ICE agents. He was filled with fear and just wanted to get home.”

According to Goetz, after Aljorna was tackled by an agent, there was a brief struggle during which his client slipped out of his sweater and ran toward his home. Contrary to the officers’ claims, neither Aljorna nor Sosa-Celis attacked the agents with any implements. “They run and retreat inside the house, behind a closed door, and that’s when they’re shot at by the agent,” Goetz explained.

The false accusations have had profound impacts on both men. “As a result of this, Mr. Aljorna has been branded a criminal, not only here but through the internet in his home of Venezuela,” Goetz said. “This person who had been living a law-abiding life up to this point is all of a sudden deemed a criminal.”

In an unusual move, ICE issued a statement acknowledging that its agents had made false statements under oath. The dismissal with prejudice is particularly significant in legal terms, as it ensures the men cannot face charges related to this incident again. The government’s motion to dismiss the case in this manner has been praised by Goetz as “a bold and affirmative step in recognizing the wrong and making concrete efforts to correct it.”

The suspended agents, who have not been publicly identified, now face parallel investigations at both the state and federal levels. This case comes shortly after the shooting of Renee Good, another incident that has raised questions about ICE operations in Minnesota.

The case highlights growing concerns about accountability in immigration enforcement and the potential consequences of aggressive tactics. As the criminal investigations into the officers’ conduct proceed, observers will be watching closely to see how accountability is handled in a case that has already involved rare admissions of wrongdoing by federal officials.
