Thai food giant CPF takes legal action against environmental group over invasive fish allegations

Charoen Pokphand Foods Public Company Limited (CPF), Thailand’s largest agro-industrial conglomerate, appeared in Nonthaburi Provincial Court on Tuesday in a defamation case involving claims about invasive fish species that the company says have damaged its reputation.

The court proceeding marked the first hearing in a criminal defamation case against Witoon Lianjamroon, Secretary-General of the BioThai Foundation, an environmental advocacy group. Prosecutors allege Lianjamroon published and circulated false information claiming CPF was responsible for the spread of blackchin tilapia, an invasive fish species that has caused ecological concern in Thailand’s waterways.

According to court documents, the BioThai Foundation allegedly distributed fabricated images and made unsubstantiated claims linking CPF to the blackchin tilapia outbreak. Lianjamroon pleaded not guilty to the charges during Tuesday’s hearing.

The Nonthaburi Provincial Court approved CPF’s motion to join the case as a co-plaintiff alongside the public prosecutor. The next step in the legal process will be a pre-trial evidence examination scheduled for December 1, 2025.

The case highlights the growing tension between Thailand’s powerful agribusiness sector and environmental groups concerned about ecological impacts. CPF, a subsidiary of the Charoen Pokphand Group conglomerate, is one of Asia’s largest food producers with operations spanning livestock, aquaculture, and processed foods across multiple countries.

Blackchin tilapia (Sarotherodon melanotheron) has become a significant environmental concern in Thailand in recent years. The non-native fish is known for its aggressive reproduction and ability to outcompete native species, potentially disrupting aquatic ecosystems. The species can survive in both freshwater and brackish environments, making it particularly adaptable and difficult to control once established.

Environmental advocates have raised alarms about the spread of invasive aquatic species in Thailand, where aquaculture is a major industry. Thailand ranks among the world’s top exporters of farmed fish products, with tilapia farming representing a significant segment of the sector. However, concerns about responsible farming practices and containment measures have grown as the ecological impact of escaped farm fish becomes more apparent.

For CPF, the legal action represents an effort to protect its brand in an increasingly scrutinized industry. Food producers face mounting pressure regarding environmental practices, with sustainability and ecological responsibility becoming key factors in consumer and investor decisions. The company has consistently maintained that it adheres to strict environmental standards across its operations.

The BioThai Foundation, founded in the early 2000s, has been vocal on issues relating to biodiversity, sustainable agriculture, and food sovereignty in Thailand. The organization has previously criticized large agribusiness conglomerates over various environmental and social impact concerns.

Legal experts note that Thailand’s criminal defamation laws are particularly stringent compared to many other countries. Critics argue these laws can sometimes be used to silence environmental activists and whistleblowers. A conviction could potentially result in imprisonment and financial penalties for Lianjamroon.

The case also comes at a time when Thailand’s aquaculture industry faces increasing regulatory scrutiny and international pressure to adopt more sustainable practices. The Department of Fisheries has been working to strengthen regulations on fish farming operations, particularly regarding the containment of non-native species.

Industry analysts suggest the outcome of this case could have broader implications for how environmental advocacy is conducted in Thailand and how corporations respond to criticism. The pre-trial evidence examination in December will likely provide further insights into the nature of the allegations and the evidence supporting both sides’ claims.

Neither CPF nor BioThai representatives provided additional comments following Tuesday’s hearing, citing the ongoing legal proceedings.
