Philippine authorities have confirmed that former President Rodrigo Duterte is not currently detained by the International Criminal Court (ICC), contrary to claims circulating on social media platforms in recent days.

The Philippine Department of Foreign Affairs issued a statement Thursday clarifying that the viral video asserting Duterte’s detention presents no factual evidence and contains misleading information about the former president’s status.

“These claims are categorically false and misrepresent both the current situation and the ICC’s procedural mechanisms,” the statement read.

Duterte, who served as the Philippines’ president from 2016 to 2022, remains under preliminary examination by the ICC for alleged crimes against humanity related to his controversial war on drugs campaign. The examination, which began in 2018, is still in its pre-trial phase, with prosecutors evaluating whether sufficient evidence exists to proceed to a formal investigation.

Legal experts familiar with ICC procedures note that the court has not issued any arrest warrants or detention orders against the former president. Professor Maria Santos of the University of the Philippines College of Law explained that the ICC operates on a complementarity principle, intervening only when national courts are unwilling or unable to prosecute.

“The ICC investigation remains at a preliminary stage. No detention has been ordered, and the court is still determining whether the case meets the threshold for a full investigation,” Santos told reporters.

The Philippine government under current President Ferdinand Marcos Jr. has maintained that the country withdrew from the Rome Statute, the treaty that established the ICC, in 2019. Government officials argue this withdrawal removes Duterte from the court’s jurisdiction, though ICC prosecutors contend they retain authority to investigate alleged crimes committed while the Philippines was still a member.

Human rights organizations estimate that between 6,000 and 30,000 people were killed during Duterte’s anti-drug operations. Official government figures acknowledge approximately 6,200 deaths in police operations, while rights groups suggest the actual number, including vigilante killings, could be substantially higher.

Duterte, 78, has remained visible in Philippine public life since leaving office in 2022. His spokesperson, Martin Andanar, called the detention claims “malicious fabrications designed to create political instability” and confirmed the former president was at his residence in Davao City.

Social media platforms have seen a surge in misinformation regarding international legal proceedings involving political figures in recent months. Meta, Facebook’s parent company, reported removing over 14,000 fake accounts spreading politically motivated misinformation in the Philippines during the first quarter of 2023.

The #FactsFirstPH coalition, a collective of media organizations, academic institutions and civil society groups formed to combat disinformation, flagged the false claim as part of their ongoing fact-checking initiative.

Digital media analyst Patricia Ramos of the Philippine Media Monitoring Center noted that false claims about international detention often gain traction because they exploit public uncertainty about complex legal processes.

“Many citizens don’t fully understand how the ICC operates, creating fertile ground for misinformation to spread,” Ramos said. “These fabricated detention claims typically surge during periods of political tension.”

The ICC’s office of the prosecutor declined to comment specifically on the false claims but referred to its public statements confirming that the preliminary examination into the situation in the Philippines continues, with no detention orders currently in effect.
