Former President Duterte Remains in ICC Custody, Release Claims False

Claims circulating on social media that the International Criminal Court (ICC) has ordered the release of former Philippine President Rodrigo Duterte are false, according to fact-checkers and court records. Duterte continues to be detained at Scheveningen Prison in The Hague, Netherlands, following his March 11, 2025 arrest on charges of crimes against humanity related to his administration’s controversial war on drugs.

The fabricated claim appeared in a Facebook group supporting Duterte that has approximately 33,000 members. The post, which has garnered significant engagement, featured a manipulated CNN news graphic showing images of Duterte alongside Senator Robinhood Padilla. Text overlaid on the image falsely stated: “Breaking News. ICC decides to release Rodrigo Duterte. The decision follows a signature campaign submitted by Robin Padilla in the Supreme Court.”

No official court documents, credible news reports, or ICC statements have confirmed any such release order. The ICC is currently reviewing Duterte’s case, with several critical rulings expected by the end of April 2026.

The pre-trial chamber is evaluating whether there are substantial grounds linking the former president to the killings during his administration’s drug war campaign, which will determine if the case proceeds to trial. Simultaneously, the ICC appeals chamber will rule on Duterte’s jurisdictional challenge. His legal team has argued that the court no longer has authority over him following the Philippines’ withdrawal from the ICC in 2019.

However, the pre-trial chamber previously ruled in 2025 that ICC jurisdiction remains valid since the alleged crimes occurred while the Philippines was still a member state. The upcoming April 22 decision will finalize whether that ruling stands.

The misleading social media post attempted to connect Duterte’s purported release to a signature campaign supported by Senator Padilla. While Duterte’s supporters claim to have collected approximately 238,000 signatures for a campaign directed at the Philippine Supreme Court as of March 2026, such efforts have no bearing on ICC proceedings, which operate independently of the Philippine judicial system.

If the charges against Duterte are confirmed in the upcoming ICC rulings, a full trial could commence by late 2026, representing a significant moment in international justice and Philippine politics.

Public opinion in the Philippines remains divided on the matter. A March 2026 WR Numero survey revealed that a majority of Filipinos support Duterte facing trial at the ICC, with nearly 60 percent stating he should personally answer the charges. More than half of respondents also expressed support for the arrest of his alleged co-perpetrators.

Despite this apparent support for accountability, public trust in the ICC itself shows significant fractures. The survey indicated roughly equal portions of Filipinos either trust the tribunal, distrust it, or remain uncertain about its fairness. Additionally, more respondents opposed the idea of the Philippines rejoining the ICC than supported it.

The case continues to draw international attention as a test of accountability for political leaders accused of human rights violations. For now, Duterte remains in custody at The Hague as the judicial process unfolds, with no indication from official sources that his release is imminent.
