False Claims Circulate About Kenya Taking Nigeria to ICC Over Separatist Leader
Recent social media posts claiming Kenya has taken Nigeria to the International Criminal Court (ICC) over the detention of separatist leader Nnamdi Kanu have been definitively debunked by officials from both nations and international court representatives.
The viral Facebook posts, which began circulating on October 24, contained explosive allegations that Kenya’s President William Ruto had “dragged” Nigeria before the ICC, banned Nigerians from entering Kenya, and frozen one trillion dollars of Nigerian assets. The posts also attributed inflammatory quotes to President Ruto, including threats that “if justice requires war, we are ready” and accusations that Nigeria had kidnapped Kanu from Kenyan territory.
A spokesperson for Kenya’s Ministry of Foreign and Diaspora Affairs dismissed these claims as “preposterous” in a statement to Reuters. Similarly, Nigeria’s Ministry of Foreign Affairs characterized the allegations as “fake news,” confirming there is no diplomatic crisis between the two African nations.
The case of Nnamdi Kanu has indeed been contentious. Kanu, a British citizen who leads the outlawed Indigenous People of Biafra (IPOB) separatist movement, was first arrested in Nigeria in 2015 but disappeared while on bail in 2017. He was later re-arrested in Kenya in 2021 and extradited to Nigeria.
Kanu’s legal team has maintained that he was abducted by Kenyan special forces before being handed over to Nigerian authorities, a claim that courts in both Kenya and Nigeria have supported. However, the Kenyan high commissioner has denied these allegations. Currently, Kanu faces seven terrorism-related charges in Nigeria stemming from his campaign for the secession of southeastern Nigeria. He denies any wrongdoing, and his case has been adjourned until November 4, 2025.
An ICC spokesperson clarified to Reuters that the fundamental premise of the viral posts was impossible, stating: “Before the ICC, cases can be opened only at the request of the ICC Prosecutor, and are always about individual responsibility, so it can’t be against a state.” The Rome Statute, which established the ICC, limits the court’s jurisdiction to prosecuting individuals for war crimes, crimes against humanity, and genocide – not resolving disputes between nations.
A review of the ICC’s official website reveals no Nigerian nationals are currently listed as defendants in any of the court’s 33 active cases. While the ICC’s Office of the Prosecutor concluded a preliminary examination into Nigeria in 2020 and has indicated it may proceed with an investigation if Nigerian authorities fail to conduct genuine proceedings into suspected crimes by Boko Haram and Nigerian security forces, this is unrelated to Kanu’s case.
For interstate disputes, the International Court of Justice (ICJ) would be the appropriate forum. However, an ICJ representative confirmed to Reuters that no case between Kenya and Nigeria exists on its current docket.
Kenya’s foreign ministry spokesperson emphasized that the two countries “enjoy positive bilateral relations” and dismissed claims of asset freezes or travel restrictions, stating there is no policy under consideration that would implement such measures against Nigeria or its citizens.
The fabricated posts appear designed to inflame tensions between the two influential African nations at a time when regional stability is particularly important for economic development and security cooperation on the continent.
This incident highlights the ongoing challenge of misinformation on social media platforms, where unverified claims can rapidly spread and potentially damage international relationships if not promptly addressed by official sources. Both Kenyan and Nigerian authorities have moved quickly to refute the false allegations, demonstrating their commitment to maintaining their diplomatic ties despite the controversy surrounding Kanu’s case.
