Irish Teacher Jailed for Contempt, Not Given Life Sentence for Transphobia
Irish teacher Enoch Burke has been indefinitely jailed for contempt of court after repeatedly violating a court order, contrary to widespread social media claims that he received a life sentence for transphobia.
Misleading posts have circulated across Facebook, X (formerly Twitter), and TikTok since early December, with one viral post on X garnering 2.5 million views. These posts shared a screenshot of a headline claiming: “BREAKING: Christian schoolteacher Enoch Burke sentenced to life in prison for transphobia.”
“Today in Ireland, Christian schoolteacher Enoch Burke was sentenced to LIFE in prison for ‘refusing to use a transgender student’s pronouns’ back in 2022. He will now spend THE REST OF HIS LIFE behind bars unless a last-ditch legal challenge works. This is absolutely INSANE,” read one widely shared Facebook post from December 4.
However, court documents reveal that Burke was committed to jail in November 2023 specifically for ignoring a court order prohibiting him from trespassing at his former workplace, Wilson’s Hospital School in central Ireland. This marks his fourth incarceration for civil contempt related to this case.
Burke’s conflict with his former employer began in August 2022 when he was suspended for objecting to a transgender student’s preferred name and pronouns and for disrupting a school event to voice his opposition. The school subsequently dismissed him and obtained a court injunction barring him from the premises.
Despite this legal prohibition, Burke persistently returned to the school, resulting in his first jailing for civil contempt in September 2022. He has been released three times since then, but each time he has refused to comply with the court order.
Justice Cregan, who presided over Burke’s most recent case, explicitly stated in the November ruling: “It needs to be restated clearly by this court – as has been stated clearly by previous courts – that Mr. Burke has not been imprisoned or fined for his views on transgender issues, which he is perfectly entitled to have and to articulate. Mr. Burke has been imprisoned, and fined, for contempt of court, because he has breached court orders directing him not to trespass on school property.”
Legal experts emphasize that imprisonment for civil contempt fundamentally differs from a criminal life sentence. According to Ireland’s Law Society Gazette and the Law Reform Commission of Ireland, civil contempt detention is indeterminate by nature, as its purpose is to compel compliance with a court order, not to punish. In contrast, criminals sentenced to life imprisonment in Ireland must serve a minimum of 12 years before being eligible for parole consideration under the Parole Act 2019.
The judge made it clear that Burke “has the keys to his own prison” and can be released immediately if he purges his contempt by agreeing to comply with the order not to trespass at the school.
After his previous release, Burke was subjected to a daily fine of 700 euros ($814) for each day he trespassed at the school. He now reportedly owes the Courts Service of Ireland more than 225,000 euros in accumulated fines.
While Burke did not respond to requests for comment, a December 3 post on his X account referred to his incarceration during the Christmas period as an “effective life sentence.” This characterization, however, misrepresents the legal reality of his situation.
The Courts Service of Ireland declined to comment on the case, which continues to draw attention to the distinctions between civil contempt proceedings and criminal sentencing in the Irish judicial system.
