Tennessee teens sue Musk’s xAI over AI-generated explicit images, seek class-action status

Three Tennessee high school students have filed a lawsuit against Elon Musk’s artificial intelligence company xAI, alleging that its image-generation technology was used to create sexually explicit images of them by manipulating their actual photographs.

The teenagers, proceeding under pseudonyms to protect their identities, filed the suit in California, where xAI is headquartered. They are seeking class-action status to represent what they claim are thousands of similar victims who were minors when sexually explicit AI-generated images of them were created and distributed.

According to court documents, one plaintiff, identified as Jane Doe 1, learned in December that someone was sharing sexually explicit images of her on social media. At least five files, including one video and four images, showed her face and body in familiar settings but altered into sexually explicit poses. The lawsuit states that the distributor, who knew the victim personally, used xAI’s image generation tools to transform innocent photos—including a homecoming picture and a high school yearbook image—into sexually abusive content.

Local police arrested the perpetrator in late December and discovered he had created explicit images of at least 18 other girls, including the lawsuit’s two co-plaintiffs. Authorities found evidence that he had uploaded these images to multiple platforms, trading them for other sexually explicit images of minors.

The lawsuit highlights a key difference between xAI and its competitors. While many AI companies have implemented strict prohibitions against generating sexually explicit content of any kind, Musk allegedly saw this restriction as a business opportunity. The court filing claims Musk actively promoted xAI’s Grok chatbot for its ability to create “spicy” content.

The plaintiffs argue that xAI knew its technology could produce sexually explicit images of children but released it anyway, claiming there is currently no effective way to block the generation of images of minors while allowing the creation of explicit adult content. According to the lawsuit, the perpetrator accessed the xAI technology either through a licensed application or by purchasing access to Grok through a third-party service.

When contacted by The Associated Press, xAI did not respond directly to the allegations. However, a January 14 statement posted on X (formerly Twitter) stated: “We remain committed to making X a safe platform for everyone and continue to have zero tolerance for any forms of child sexual exploitation, non-consensual nudity, and unwanted sexual content.” The statement added that the company takes action to remove violative content and reports accounts seeking Child Sexual Exploitation materials to law enforcement.

For the teenage plaintiffs, the impacts extend far beyond the legal proceedings. They express deep concern that these fabricated but realistic-looking images will permanently circulate online. The lawsuit details how the students fear stalking since their real first names and school are associated with the files. They also worry about their friends, classmates, and future acquaintances seeing these convincing fake images.

The psychological toll has been severe. Jane Doe 1 reports suffering from anxiety, depression, and stress, with difficulties eating and sleeping along with recurring nightmares. Jane Doe 2 has begun self-isolating, avoiding school, and dreads attending her own graduation. Jane Doe 3 lives with constant fear and anxiety that someone will recognize her face in the AI-generated images.

This case highlights the emerging dangers of misused AI image generation technology, particularly for vulnerable populations like minors. It also raises questions about the responsibilities of AI companies in preventing the misuse of their technology and the adequacy of current safeguards against the creation of harmful content.
